CFPB seeks rescission of pandemic-era mortgage servicing rule

The Consumer Financial Protection Bureau (CFPB), under the leadership of acting director Russell Vought, is continuing to assess regulations it deems outdated or unnecessary.

To that end, the bureau published a notice in the Federal Register this week that seeks to rescind a 2021 rule which “temporarily permitted mortgage servicers to offer certain loan modifications made available to borrowers experiencing a COVID-19 related hardship.”

The rule also “finalized certain temporary amendments to Regulation X related to the COVID-19 pandemic,” referring to the implementing regulation of the Real Estate Settlement Procedures Act (RESPA).

“The rule stated that the temporary procedural safeguards do not apply if a servicer makes the first notice or filing required by applicable law for any judicial or non-judicial foreclosure process on or after January 1, 2022,” the notice stated.

“In addition, the rule stated that the temporary COVID-19 related live contact requirements would only be required until October 1, 2022.”

In April 2023, President Joe Biden signed a joint resolution from Congress that terminated the COVID-19 national emergency. The bureau said this gives it “good cause to remove, without prior notice and comment, language relating to the COVID-19 pandemic added by the 2021 COVID RESPA Rule.”

With the national health emergency having expired two years ago, Vought said that “borrowers and servicers are no longer utilizing these safeguards.”

He also cited a July 2024 proposed rule, which would amend Regulation X and require servicers to emphasize borrower assistance and loss-mitigation options over foreclosure when a borrower struggles to make their required mortgage payments.

The entry in the Federal Register also provides additional perspective on the current approach the CFPB is taking to rule making under Vought’s leadership.

It describes the bureau’s stance to “streamline regulatory requirements to reduce burdens on the American public,” and it has determined that the end of the pandemic means that these rules “needlessly complicate Regulation X without commensurate benefits.”

The bureau is accepting public comments on the proposed rescission, which can be submitted through the proposal’s Federal Register portal through June 16.

Vought’s time as CFPB director may last longer than initially planned. President Donald Trump’s nominee to serve as full-time director, Jonathan McKernan, was recently named for a key position at the Department of the Treasury. The president subsequently pulled McKernan out of consideration as CFPB director.

It was also recently observed that the CFPB’s official accounts on social media platforms Facebook and X, formerly known as Twitter, are no longer available.

Lone Wolf’s LionDesk CRM platform to be discontinued

Lone Wolf Technologies is reportedly discontinuing LionDesk, the customer relationship management (CRM) platform it acquired in 2021.

LionDesk will remain operational through September, giving users time to migrate their data and transition to Lone Wolf’s new CRM known as Relationships.

Customers will be able to transfer their contacts and are being offered accounts with full migration support, Lone Wolf CEO Jimmy Kelly told Inman.

“This is not a decision we take lightly,” Kelly said. “It’s been part of our family for a few years now, but when we got into LionDesk we learned, unfortunately, that it wasn’t going to fit the need of that longer-term vision.”

Kelly told Inman that technical limitations prevented LionDesk from scaling in line with Lone Wolf’s vision.

The company began to notify customers of the shutdown “a few weeks ago,” according to Kelly.

The new CRM, Relationships, can be purchased independently. Pricing will be comparable to LionDesk, which started as low as $25 per month for some accounts, Inman reported.

“At the time, we didn’t have front-end pieces, and LionDesk was actually our first CRM acquisition because we felt we’d go with an industry favorite as opposed to build a CRM from scratch,” Kelly said. “The second part was we wanted to bring in some folks with really strong industry backgrounds.”

Lone Wolf software is used by more than 9,000 brokerages and 1.5 million agents. The company has partnered with more than 300 multiple listing services and 60-plus Realtor associations.

LionDesk was one of several real estate tech companies Lone Wolf acquired in a short period of time. These included HomeSpotter and W+R Studios, the maker of Cloud CMA.

Social Security sees ‘dramatic’ spike of 276,000 applications

Social Security benefits are often a key for older Americans as they seek to determine how much money they will be able to live on in retirement.

But the program has been a source of stress in the federal government for years, exacerbated by the unwillingness of lawmakers to make any major changes to the highly popular — and very expensive — social safety net.

But the discussion taking place now around economic indicators and the likelihood of a recession appear to be key factors in a rush of new filings to commence benefit payments.

According to research from the Urban Institute cited in a report from The New York Times, 276,000 additional Social Security applications were submitted during the first 10 months of the current fiscal year.

This marks an increase of roughly 13% from the same time span one year earlier, researchers told the Times. The outlet also reported that Social Security Administration (SSA) employees viewed this spike as “dramatic.”

Jack Smalligan, a senior policy fellow at the Urban Institute, told the Times that the trend is “worrisome” since taking benefits early is not typically seen as a “good decision.” Common advice involves waiting to initiate benefit payments starting at age 70 to maximize payments in later years.

“They’re nervous about the threats to the Social Security Administration and their benefits, while simultaneously looking at their 401(k), if they have one, and worrying about that,” Smalligan said.

One new beneficiary explained some of his reasons for choosing to take benefits now instead of waiting a few more years to maximize payments. Chief among these was the whipsawing of the financial markets in response to White House tariff policies.

“The market drop was the final straw,” he told the Times. He later said that the claims process went smoothly and that he began receiving his payments 12 days after application.

He also cited the swift and disruptive moves by the Trump administration to reduce the size of the federal government, which caused issues at SSA in recent months and led to public backlash and confusion in some cases. This stems from some rules that were announced and then quickly walked back, evoking a sense of discord among those reliant on the program.

In March, the agency announced its intention to implement new in-person identity verification requirements and unveiled plans to close more than two dozen field offices across the country. Advocates for retirees argued that the moves would worsen the ability of older Americans to engage with a program that often serves as their sole source of income in later life.

Later that month, the agency announced that it would permit identity verification processes to be conducted over the phone. But advocates argued this was not enough to stem the tide of unease about the future of the program and its administration.

Reverse mortgage LOs share appraisal challenges at NRMLA event

Reverse mortgage originators often remain a key point of contact for their clients from initial consultation to long after the loan closes. But getting to the closing table can come with its own set of unique challenges, whether it comes from rules that govern the Home Equity Conversion Mortgage (HECM) program or the potential bias of an appraiser.

This message was shared by a panel of reverse mortgage originators who met last month at the National Reverse Mortgage Lenders Association (NRMLA)’s Western Regional Meeting in Irvine, California.

The initial question that started this part of the conversation was more general in nature. But the panel quickly jumped on issues they’ve face with appraisals as a key impediment in the closing process.

Second appraisals

In September 2018, the Federal Housing Administration (FHA) announced a new requirement for HECM lenders that resulted in some loan applications requiring a second appraisal. The rule was implemented with the aim of stemming losses to the Mutual Mortgage Insurance (MMI) Fund. It went into effect for all case numbers assigned starting in October of that year.

Opinions among reverse mortgage professionals about the second appraisal requirement has varied over the years. Some continue to call it the single biggest issue they face in their business, while others say they have adapted and adjusted to it.

But at the panel in Irvine, second appraisals were immediately cited by Lisa Moriello of loanDepot as an impediment to closing a loan.

She also cited the reconsideration of value (ROV) process as an issue, which can lead to strange requests for the clients themselves.

“I literally just had an investor come back to me, and [they] asked my 80-year-old client to provide a 12-month history of condominium sales in the area, and how they were increasing,” Moriello explained.

“I don’t even have a subscription for that, so how do you expect a client to do it? How do we mitigate that risk? I don’t really have an answer for you.”

Possible bias, preparation

Ernie Severson of Summerlin Financial Inc. cited appraisal bias as an issue. He suggested that appraisers may look at a property differently if they’re aware that the appraisal has been requested for a reverse mortgage transaction.

“I know that’s a big topic, but they need to look at it in the terms of seniors,” Severson said. “And the fact that we have the AMC is a great step, but an appraiser should not know this is a reverse mortgage before they get [to the property]. And unfortunately, they can say they’re not biased to it or anything else, but it’s all risk mitigation.”

Tom O’Donoghue of Reverse Loans Now suggested that it’s a good idea to document the experiences that LOs and customers have with particular appraisers, noting the values that are determined and the experiences that clients have with an appraiser.

O’Donoghue also advises his clients to tell him who their appraiser is. He then checks notes to see if there have been any issues from past interactions.

Moriello added that clients can indicate they’ve had a bad interaction with an appraiser. If they appear stressed, or if they feel they’ve been spoken to in a condescending manner, that can be a sign of a poor experience.

Christina Harmes Hika, a loan originator who attended the event, shared advice about recording a video to give customers an idea of what to expect from an appraisal. This can make them feel more confident and prepared once the appraiser appears at their door.

Harmes Hika and other industry professionals have previously recommended video tools like Loom, which can be shared with the borrower and any trusted advisers to walk them through the particulars of a reverse mortgage.

HUD approves Asheville’s hurricane recovery plan after initial objection over DEI

After an initial rejection and amendment of its required Hurricane Helene recovery plan as it seeks more than $200 million in federal funds, the City of Asheville, North Carolina’s revised plan has received approval from the U.S. Department of Housing and Urban Development (HUD).

In March, HUD rejected Asheville’s initial draft action plan, a required step to access the $225 million in Community Development Block Grant-Disaster Recovery (CDBG-DR) funds first approved near the end of the Biden administration. The allocation was announced on Jan. 7 by North Carolina Gov. Josh Stein (D) and then-acting HUD Secretary Adrianne Todman.

Two weeks later, President Donald Trump was inaugurated for the second time and he ultimately chose Scott Turner as the new HUD secretary. In March, Turner said the draft action plan submitted by the city conflicted with the Trump administration’s efforts to bar diversity, equity and inclusion (DEI) programs from receiving federal funding.

Asheville subsequently made revisions to the plan and resubmitted it to HUD. While awaiting approval on the revised plan, the department signed off on North Carolina’s action plan that sought $1.4 billion in recovery funding for the state.

The city announced on Thursday that the revised plan had been approved. It called the move “a major milestone in the process to access the funding, which was allocated by HUD on Jan. 16, following a December 2024 Congressional appropriation.”

According to the announcement, the plan allocates $125 million for infrastructure, $52 million for economic revitalization, $31 million for housing, $11.2 million for administration, $3.7 million for planning and $2 million for public services.

The funds are not yet ready to be released, however, since HUD must still approve the city’s “financial, procurement, and grant management practices to certify that the city is prepared to effectively manage the grant funds,” the city said in its announcement.

Asheville “has already submitted all of the documentation necessary for HUD and is awaiting certification. Once certified, HUD will distribute a grant agreement, which both the city and HUD will sign,” the announcement explained.

“We moved quickly because we understand how critical this funding is for our community,” Asheville Mayor Esther Manheimer said in a statement. “We’re grateful to HUD for their swift decision, and our entire council is pleased with how well the plan incorporates community feedback.”

Conversations between city leaders and HUD are ongoing as they continue to demonstrate compliance and governance responsibilities according to Nikki Reid, the city’s community and economic development director

“We’re talking every day about how to use these funds effectively and efficiently in our community, including developing program area guidelines and manuals,” Reid said.

“Planning projects, such as the French Broad Riverfront Parks Recovery project, are being identified and programs will be rolled out as they are created. We expect the first programs to kick off this fall.”
